apple has iPhone, but no FCC authorization
Early this morning (actually, in Eastern Europe is evening), Apple announced it’s new device, the iPhone.
Later, on apple.com, I’ve seen a strange text.
This device has not been authorized as required by the rules of the Federal Communications Commission. This device is not, and may not be, offered for sale or lease, or sold or leased, until authorization is obtained.
Is Apple marketing something not approvedby the FCC? IS this legal?

The problem is not that the iphone isn’t approved by the FCC, but the fact that it isn’t authorized. Cisco own the trademark ‘iphone’ and have been sitting on it for years and not done a damn thing with it.
So now Cisco are trying to make as much money as they possibly can for letting Apple use the name. Perhaps they saw the iphone happening and this was the plan all along?
However because Cisco hasn’t utilized the trademark on any product, the case is significantly weakened.
All of this should be irrelevant because Apple could call it the ’shitphone’ and it would still sell like hotcakes. Damn perfectionists.
So in answer to your question it most certainly is legal, and i feel pretty confident we will see the iphone released reasonably soon.
